What are the rights and obligations of Suppliers and End Customers of electricity regarding situations of unregistered absconding/consumption?
 
Law No. 123/2012, in Art. 53 and Art. 58:
 
Obligations of the supplier of last resort (Article 53):
2. The supplier of last resort shall be obliged to supply electricity to final customers whose supplier is in a position to have his supply licence revoked in the course of the course of the activity or in any other situation identified by the competent authority in which the final customers have not ensured the supply of electricity from any other source, with the exception of customers disconnected for evading electricity or non-payment, in accordance with the regulations issued by the competent authority.
 
Obligation to contract (Article 58):
 
4. The supplier shall be entitled to terminate the contract in the following cases:
(a) the removal of electricity established by a final judgment;
(b) non-payment of invoices;
(c) other situations provided for by the legislation in force.
5. The supplier shall be entitled to require a final customer to provide financial guarantees for a period of consumption equivalent to a maximum of one year in the event of the finding, in accordance with the legal provisions in force, of actions designed to distort in any way the indications of the measuring equipment or to evade electricity by bypassing the measuring equipment on its part.
The method of setting up financial guarantees is laid down in the framework contracts for the supply of electricity and/or other regulations issued by ANRE.

How can I change my electricity supplier?

Change of electricity supplier - Art. 29
(1) In order to change the supplier of a place of consumption, the final customer has the right to unilaterally terminate the supply contract, subject to the contractual conditions, with the obligation to notify the electricity supplier at least 21 days in advance, in compliance with the provisions of the specific procedure, approved by order of the ANRE President. 
(2) The final customer whose place of consumption has been taken over by the FUI may change the electricity supplier under the conditions and deadlines laid down by the regulations in force. 
(3) Household customers and non-household final customers who are beneficiaries of the universal service are not required by the electricity supply contract to pay any amount of money for the change of electricity supplier. 
(4) Electricity suppliers may charge final customers other than those referred to in paragraph 1 the following: (3), commissions for the termination of fixed-term and fixed-price electricity supply contracts in the event of their unilateral denunciation by the final customer before they are reached.
(5) The fees referred to in paragraph 1 shall be paid in accordance with the procedure laid down in Article (4) must meet cumulatively the following requirements: 
(a)be clearly communicated to the customer before the conclusion of the contract; 
(b)be provided for in the supply contract which the customer has signed; 
(c)be proportionate and not exceed the amount of direct economic losses caused by the customer to the supplier through the termination of the contract, including the costs of any investment packages or services already provided to the client under that contract. The burden of proof of direct economic losses lies with the supplier.
